Terms of Service

1. Acceptance of Terms

By accessing or using Maestro AI ("Service"), provided by SurgeXi Business Intelligence ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Maestro AI is an AI-powered workspace platform that provides chat-based AI assistance, command execution, project management, and related tools. The Service is available in Free, Pro, Premium, and Enterprise tiers.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Data Ownership and Privacy

Your data belongs to you. We do not store your chat history, project files, or personal data on our servers unless you explicitly opt into paid cloud storage. All data in the Free tier is stored locally on your device. See our Privacy Policy for details.

5. BYOK (Bring Your Own Key)

When you connect third-party API keys (OpenAI, Anthropic, Google), those keys are encrypted and stored locally. We do not access, log, or transmit your API keys to any third party. Usage of third-party AI models is subject to those providers' terms of service.

6. Acceptable Use

You agree not to: (a) use the Service for illegal purposes; (b) attempt to gain unauthorized access to other users' data; (c) reverse engineer the Service; (d) use the Service to develop competing products; (e) exceed rate limits or abuse the API.

7. Paid Subscriptions

Pro, Premium, and Enterprise tiers require payment. Subscriptions are billed monthly. You may cancel at any time. Refunds are provided on a case-by-case basis within 14 days of purchase.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. SurgeXi Business Intelligence shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

9. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email or in-app notification.

10. Governing Law

These Terms are governed by the laws of the State of Alabama, United States. Any disputes shall be resolved in the courts of Jefferson County, Alabama.
